Vågan The Municipal Council adopted the following in case KS-040/24:

«The municipal regulation on reduced concession limit for developed property that is or has been used as a

year-round residence (Residency requirement) is sent for public consultation, and sent to all residents' associations and neighbourhood groups in

Vågan.

Consultation deadline: 6 weeks. Input is mainly requested on the various alternatives:

  • Abolition of the residency requirement in the entire municipality

  • Abolition of the residency requirement in the entire municipality, except Henningsvær

  • Maintaining the residency requirement as it is today

  • Maintaining the residency requirement with extension to Svolvær and Kabelvåg

  • Repeal of the kinship exemption

  • The residency requirement is extended to undeveloped and developed areas zoned for residential purposes, and in those cases where

residential properties in areas zoned for combined purposes apply for a change of use to another

purpose.»

The various alternatives on which the Municipal Council wishes to receive input are briefly explained below:

Abolition of the residency requirement in the entire municipality

This means there will be no residency requirement for properties under 100 hectares that are developed with

residential buildings.

Abolition of the residency requirement in the entire municipality, except Henningsvær

This means the residency requirement applies to properties developed with residential buildings that have been used as a

year-round residence in Henningsvær.

Maintaining the residency requirement as it is today

This means no change from today. There will be a residency requirement for properties under 100 hectares

developed with residential buildings that have been used as a year-round residence. The residency requirement applies in the entire municipality

except in Svolvær and Kabelvåg.

Maintaining the residency requirement with extension to Svolvær and Kabelvåg

There will be a residency requirement for properties under 100 hectares developed with residential buildings that have been used

as a year-round residence.

Repeal of the kinship exemption

This means that close relatives will also be subject to the residency requirement if they take over a property under 100 hectares that is

developed with residential buildings that have been used as a year-round residence.

The residency requirement is extended to undeveloped and developed areas zoned for residential purposes, and in those cases where

residential properties in areas zoned for combined purposes apply for a change of use to another

This means there will be a residency requirement on undeveloped and developed properties if they, through

a zoning plan, are zoned for residential purposes/residential development. That is, if a property zoned for2

residential purposes has a residential building under construction or a newly built residential building, there will be a residency requirement. The

same applies if the property is undeveloped. In that case the applicant has 1 year to construct a residential building

and settle on the property.

For residential properties (i.e. properties developed with a residential building) zoned for combined purposes, the

residency requirement will apply as long as the property is developed with a residential building that has been used as a

year-round residence (this also applies today). The residency requirement cannot apply to residential properties

zoned for combined purposes as long as it is developed with a residential building that has not been used as a

year-round residence or if it is not developed with a residential building. That is, if a residential property is zoned for

combined purposes (which is not developed with a residential building that has been used as a year-round residence), the

municipality cannot impose a residency requirement. In that case the zoning plan must be changed, and the purpose changed from combined to

residential purposes.
